Terms of Sale and Use

1. Purpose

These terms and conditions (the “Terms”) govern the use of the Trifouille service (the “Service”), published by Quentin Brugeille (the “Publisher”), and the subscription to the Trifouille Pro plan, by any individual or legal entity (the “User”). Using the free plan constitutes acceptance of the Terms. Subscribing to the Pro plan requires their express acceptance, by ticking a checkbox. The applicable version is the one accepted at the time of subscription.

2. Description of the Service

Trifouille automatically reorganizes the contents of a ZIP archive uploaded by the User and returns a new archive. The original archive on the User's device is never modified.

• Free plan, no account: archives up to 200 MB, sorting by file type and by date.
• Pro plan, with an account: archives up to 5 GB each, topic-based sorting assisted by artificial intelligence, and sorting history.

Uploaded files are processed temporarily and deleted from the servers as soon as processing is complete. Sorting by artificial intelligence relies solely on file names and paths, never on their contents. It is an automatic suggestion, which the User reviews in the preview before downloading the archive.

3. Account

Sign-in works through a single-use link sent to the User's email address. The User is responsible for the security of their mailbox. They can delete their account at any time from the account menu.

4. Price

The Pro subscription costs €4.99 per month, or $4.99 per month if the User chooses to pay in US dollars (VAT not applicable, article 293 B of the French Tax Code (CGI)). The currency is chosen at the time of subscription and remains the currency of the subscription. Any conversion fees charged by the User's bank are borne by the User. The Publisher may change this price. Any change is announced by email at least 30 days before it applies, and takes effect at the next renewal. A User who does not accept the new price may cancel their subscription before that date.

5. Subscription and payment

Payment is made by card through the secure payment provider Stripe. Trifouille never has access to card details. The first month is charged at subscription, then every month on the same date. Invoices are available from “Manage subscription”. If a payment fails, Stripe retries the charge for a few days. If payment does not go through, the subscription ends and the account reverts to the free plan.

6. Term, renewal and cancellation

The subscription is taken out for one month and renews automatically every month, with no minimum term. The User can cancel it at any time, in a few clicks, from the account menu (“Manage / cancel subscription”). Cancellation takes effect at the end of the current monthly period, already paid for, until which Pro features remain available. Except when the right of withdrawal is exercised (section 7), no pro rata refund is made. Deleting the account cancels the subscription immediately.

The Publisher may suspend or terminate the access of a User who seriously breaches section 8, after informing them, except in an emergency or where required by law.

7. Right of withdrawal

A User who is a consumer has 14 days from subscription to withdraw, without giving any reason (article L221-18 of the French Consumer Code, Code de la consommation).

By ticking the checkbox provided at subscription, the User expressly requests that the Pro Service begin as soon as payment is made, before the end of that period. If they withdraw afterwards, they must pay an amount proportional to the service provided until they communicated their decision (article L221-25). The Publisher refunds the balance within 14 days, using the same means of payment.

8. User obligations

• Only upload files they have the right to hold and process, with no unlawful content.
• Not circumvent plan limits or overload the Service (massive automated requests, intrusion attempts, malicious archives).
• Keep their own copies of their files: the Service does not store them.

9. Availability and liability

The Publisher makes its best efforts to keep the Service available and working properly, under a best-efforts obligation (obligation de moyens). The Service may be interrupted for maintenance. Towards professional Users, the Publisher's liability is limited to direct damages and capped at the amounts paid over the last 12 months. No provision of the Terms limits the rights that consumers hold under the law.

10. Legal guarantee of conformity

For consumers, the Publisher is liable for any lack of conformity of the Service throughout the period during which it is supplied, under the conditions of articles L224-25-1 and following of the French Consumer Code. The User may in particular obtain that the Service be brought into conformity or, failing that, a price reduction or termination of the contract.

11. Personal data

The processing of personal data is described in the privacy policy.

12. Complaints and mediation

Any complaint may be sent to contact@trifouille.com. If the written complaint is not resolved, the consumer may refer the matter free of charge to the consumer mediator CM2C (Centre de la Médiation de la Consommation de Conciliateurs de Justice) (https://www.cm2c.net), within one year of their written complaint (articles L611-1 and following of the French Consumer Code).

13. Changes to the Terms

The Publisher may change the Terms. Subscribers are informed by email at least 30 days before the new version comes into force, and it applies at the next renewal. A subscriber who does not accept it may cancel their subscription before that date.

14. Governing law

The Terms are governed by French law. In the event of a dispute, the consumer may bring the matter before the court of the place where they lived when the contract was concluded or when the harmful event occurred. For professionals, the courts with jurisdiction over the Publisher's registered office have exclusive jurisdiction.

This English version is a courtesy translation. In case of any discrepancy with the French version, the French version prevails.
